Parties

This Public Offer Agreement (hereinafter "Agreement") is concluded between:

Seller: Sole Proprietor Pankova Olena Oleksandrivna, acting under the laws of Ukraine

and any individual placing an order on the Website (hereinafter "Buyer").

In accordance with Articles 633 and 641 of the Civil Code of Ukraine and the Law of Ukraine "On Electronic Commerce" No. 675-VIII, this Agreement constitutes a public offer. By placing an order, the Buyer accepts all terms of this Agreement in full.

1. General Provisions

1.1. This Agreement governs all purchase and sale relations between the Seller and the Buyer on the Website.

1.2. The Agreement is governed exclusively by the laws of Ukraine, including:

• Law of Ukraine "On Consumer Protection" No. 1023-XII
• Civil Code of Ukraine No. 435-IV
• Law of Ukraine "On Electronic Commerce" No. 675-VIII
• Law of Ukraine "On Personal Data Protection" No. 2297-VI

1.3. The Seller reserves the right to amend this Agreement at any time. Changes take effect upon publication on the Website.

1.4. By placing an order, the Buyer confirms that they:

• Are at least 18 years of age
• Have read and accepted all terms of this Agreement
• Consent to the processing of their personal data as described in our Privacy Policy

2. Subject of the Agreement

2.1. The Seller agrees to transfer ownership of the selected goods (hereinafter "Goods") to the Buyer, and the Buyer agrees to pay for and accept the Goods under the terms of this Agreement.

2.2. The range of available Goods is published on the Website and may be updated at any time.

2.3. All Goods are handcrafted in limited editions. The Seller does not guarantee the continuous availability of any specific item.

2.4. Product images on the Website are for illustrative purposes. Minor variations in color may occur due to display settings.

3. Pricing

3.1. All prices are listed on the Website in EUR (for international orders) or UAH (for orders within Ukraine).

3.2. The price of the Goods does not include delivery costs. Shipping is calculated separately at checkout based on destination and package weight.

3.3. The Seller reserves the right to change prices at any time. Price changes do not apply to orders that have already been paid.

3.4. If a pricing error occurs on the Website, the Seller will notify the Buyer before processing the order. The Buyer may confirm or cancel the order.

4. Ordering

4.1. Orders are placed through the Website by completing the checkout form.

4.2. By submitting an order, the Buyer confirms the accuracy of the information provided, including name, contact details, and delivery address.

4.3. The Seller will confirm receipt of the order via email within 1 business day.

4.4. The Agreement is considered concluded from the moment the Buyer’s payment is successfully processed.

4.5. The Seller reserves the right to cancel an order if:

• The Goods are out of stock
• The Buyer’s payment cannot be processed
• The provided information is inaccurate or incomplete

5. Payment

5.1. Payment is accepted in EUR (international orders) and UAH (Ukraine).

5.2. Available payment methods:

• WayForPay — Visa, Mastercard (EUR and UAH)
• PayPal — Visa, Mastercard or PayPal balance (EUR)

5.3. All payments are processed through secure encrypted connections. The Seller does not store the Buyer’s card details.

5.4. The order is processed after full payment is confirmed.

5.5. In case of a failed payment, the order is not confirmed. The Buyer may retry the payment or choose an alternative payment method.

6. Delivery

6.1. The Seller ships via Nova Poshta Global to 200+ countries worldwide (except Russia and Belarus).

6.2. Within Ukraine, delivery is carried out via Nova Poshta to any branch or address.

6.3. Orders are dispatched every Monday, Wednesday, and Friday. Orders placed after 5:00 PM are shipped on the next dispatch day.

6.4. Estimated delivery times:

• Ukraine: 1−3 business days
• International: 7−21 business days depending on destination

6.5. Delivery times are estimates and may vary due to customs procedures, public holidays, or other circumstances beyond the Seller’s control.

6.6. Shipping costs are calculated at checkout and are the responsibility of the Buyer.

6.7. International orders may be subject to customs duties and local taxes upon arrival. These charges are the sole responsibility of the Buyer. The Seller does not collect or reimburse customs duties.

6.8. The Seller is not responsible for delays caused by customs authorities or the delivery carrier.

6.9. Upon receiving the parcel, the Buyer must inspect the Goods in the presence of the courier or Nova Poshta representative. Any visible damage must be reported immediately and documented.

7. Returns and Exchanges

7.1. The Buyer may return or exchange Goods within 14 calendar days from the date of receipt, in accordance with Articles 9−13 of the Law of Ukraine "On Consumer Protection."

7.2. Returns and exchanges are accepted only if the Goods:

• Are in original condition
• Have not been worn or washed
• Have all original tags and labels attached
• Are accompanied by proof of purchase

7.3. The following items are not eligible for return or exchange:

• Items that have been worn or washed
• Items without original tags
• Items from the non-returnable goods list under Resolution of the Cabinet of Ministers of Ukraine No. 172 dated March 19, 1994

7.4. Return procedure

1. Fill out the return form included in the package
2. Photograph the completed form
3. Send the photo to our Instagram: @munstudio__
4. After confirmation, ship the item to: Pankova Kateryna, Odesa Region, Chornomorsk City, Malodolynske, Branch No. 1 (22a Myru St.), +380 637 353 095
5. Ship without cash on delivery. Declare the value equal to the original order price.

7.5. Return shipping costs are the responsibility of the Buyer.

7.6. Refunds are processed within 5 business days after the Seller receives and inspects the returned item.

7.7. Exchange procedure
1. Contact us via Instagram: @munstudio__ with your order number
2. Confirm availability of the desired item
3. Ship the original item to the address above
4. The replacement item will be shipped within 5 business days after receiving the return

7.8. Parcels sent with cash on delivery or with shipping costs charged to the Seller will not be accepted.

7.9. For international returns, please contact us via Instagram or email before shipping to arrange the return.

7.10. If the Buyer paid customs duties on the original order, the Seller cannot refund those duties.

8. Rights and Obligations

9. Liability

9.1. The Seller is not liable for:

• Delays caused by the delivery carrier or customs authorities
• Damage caused by the Buyer’s incorrect use of the Goods
• Losses resulting from force majeure circumstances

9.2. The Seller’s liability is limited to the value of the Goods ordered.

9.3. The Buyer is responsible for providing accurate delivery information. The Seller is not liable for non-delivery due to incorrect address details.

10. Force Majeure

10.1. Neither party is liable for failure to fulfill obligations due to circumstances beyond their reasonable control, including but not limited to: war, martial law, natural disasters, government restrictions, carrier disruptions, or power outages.

10.2. The party affected by force majeure must notify the other party as soon as reasonably possible.

11. Dispute Resolution

11.1. All disputes shall be resolved through negotiation between the parties.

11.2. If no agreement is reached, disputes shall be resolved in accordance with the laws of Ukraine.

11.3. EU residents retain the right to contact the consumer protection authority in their country of residence.

12. Personal Data

12.1. By placing an order, the Buyer consents to the collection and processing of their personal data for the purposes of order fulfillment, delivery, and customer support.

12.2. Personal data is processed in accordance with our Privacy Policy, available at: munstudio.store/privacy-policy

13. Term and Termination

13.1. This Agreement comes into effect upon the Buyer placing an order and remains valid until all obligations of both parties are fulfilled.

13.2. The Seller may terminate the Agreement unilaterally if the Buyer violates its terms.
